General terms and conditions of use of the website
Access, use and any other fruition of the website www.premafanclub.com and of the pages and/or third-level domains linked to it (“Website”), imply knowledge and acceptance of these general terms and conditions of use of the Website (“Terms and Conditions of Use”) by those who interact with it (“Users”).
If the User does not agree to all or part of these Terms and Conditions of Use, is requested to leave the Website and not to use its services and/or functionalities. Furthermore, any material downloaded or printed from the Website must be immediately destroyed.
The Owner (as defined below) has the right to make any changes to the Website at any time and without any obligations to give notice and shall not be liable for any failures to update the content of the Website.

2. Purpose and use of the Website
The purpose of the Website is to provide information about the Owner as well as to allow the User to become a member of the non-profit unrecognized association with cultural purposes “Prema Fan Club”, i.e. the Owner.
Access to and navigation on the Website are free of charge and are not subject to the creation of a customer account by the User.
3. Recipients
The Website is aimed at any professional and customer consumer within the meaning of the Consumer Code (Legislative Decree 206/2005).
Users are solely liable for the truthfulness, correctness and completeness of the information provided when browsing the Website and, in particular, when filling out the forms available on the Website, including the form required for Fan Club membership.
4. Intellectual property rights
The Owner is the exclusive owner or licensee of any intellectual or industrial property rights (“IP Rights”) related to the Website and the materials contained in it, including, by way of example but not limited to, trademarks, logos and any other distinctive sign, creative works such as texts, photographs, images, layouts, graphics, illustrations, graphics design, videos and documents (“Materials”).
Unless otherwise expressly agreed in writing, nothing in these Terms and Conditions of Use shall be interpreted as a transfer or grant of any licenses and/or authorization to any IP Rights.
Users are authorized to view, print, download and use the Materials for informational purposes only and/or in order to read and accept the relevant terms, provided that such activities are carried out in a manner consistent with these Terms and Conditions of Use.

In the case of breach of this Article, the Owner shall have the right to take action before the competent national or international authorities in order to safeguard its rights against the offender.

The processing of the User’s personal data by the Owner is carried out according to the provisions set out in the “Website Privacy Policy” which is available on the Website.

Without prejudice to the provisions of Article 7, the Owner undertakes to adopt appropriate technical (hardware and software) and organizational security measures to preserve the inviolability and security of the Website and its operation.

The Website may contain hypertext links (hereinafter, “Links”) to web pages, platforms or social networks external to the Website, also by means of social buttons or widgets. Such Links are proposed in order to facilitate Users in their browsing activities, by facilitating hypertext links to online information deemed useful and/or relevant. Except in cases of willful misconduct or gross negligence, the Owner shall not and can never be held liable for the contents of external sites, especially regarding the processing of personal data during browsing operations.

If such Links constitute unfair or unjust business practices or result in one or more violations of IP Rights, the Owner has the right to block and/or remove such Links from the Website.
In any case, it is forbidden the activation of deep hypertext Links to the Website, such as embedding, inline linking, or other types of deep linking – hot-linking, including certain types of framing, such as the unauthorized use of meta-tags/keywords that contain and/or reproduce distinctive signs of the Owner.
Moreover, any form of web scraping is prohibited.
7. Limitation of liability
By accessing the Website, Users shall be solely liable for the use thereof, as well as for the use of the Materials contained therein.
Users shall be solely liable for any communication of information and/or data that results to be incorrect, false or referable to third parties in the absence, where required, of the latter's consent, as well as for any use of the Website that does not comply with the principles of fairness and good faith.
Except in cases of willful misconduct or gross negligence, any liability for damage, direct or indirect, to computers, software and/or loss of data caused by the downloading of Materials freely downloaded by the Users shall fall on the Users themselves and can never be attributed to the Owner.

Without prejudice to the adoption of appropriate technical and organizational security measures as set out in Article 5, the Owner declines all liability for damages related to any unauthorized access to the Website by third parties and any related alterations, as well as any failure and/or malfunctioning of the Users’ hardware or software.
In any event, the Owner shall never be liable for any damage caused to third parties because of the unlawful use of the Website by the User.
8. Update of Terms and Conditions
The Owner reserves the right to unilaterally amend these Terms and Conditions of Use at any time. The new version of the Terms and Conditions of Use will be published on the Website and the use of the Website following the changes will imply acceptance of the same.
